A misdemeanor assault and battery charge against a Spotswood Elementary School assistant principal was dismissed Friday in Spotsylvania County Juvenile and Domestic Relations Court.
Misty Kelley was accused of assaulting a 5-year-old first-grade student on Aug. 28.
The girl’s mother told the Free Press that her daughter had “huge” marks and bruises on her back and ribs and attributed them to a woman with curly hair and glasses who turned out to be Kelley.
A judge reviewed a video of the alleged incident in court Friday and determined that no assault took place.
Kelley was placed on paid administrative leave after she turned herself in to the Spotsylvania Sheriff’s Office. She said Friday that she’s “hopeful and optimistic” to return to her position after the winter break.
